Rules and Conditions
MISFIT’s binding rules and zero-tolerance policy.
1. Scope and acceptance
These Rules and Conditions govern access to and use of MISFIT, a digital service intended exclusively for adults who wish to meet other people. By registering, accessing or using the service, the user confirms that they have read, understood and accepted this document, the Conduct Guidelines and the applicable Privacy Notice.
Anyone who does not accept every applicable provision must not register or use MISFIT. Acceptance is recorded electronically with its date and time.
By accepting these Rules and Conditions, the user also confirms having reviewed the Privacy Notice. The user explicitly consents to the processing of the MISFIT groups they voluntarily select, solely to operate the profile and the search or matching system. Consent may be withdrawn as explained in the Privacy Notice; withdrawal may limit or make unavailable functions that depend on those groups.
2. Adults only
MISFIT is available solely to users who have reached the legal age of adulthood in their country and, in all cases, are at least eighteen years old. Creating an account for a minor, allowing a minor to use an account, or knowingly communicating with a minor through the service is forbidden.
Any reasonable concern involving a minor may result in immediate precautionary suspension without notice and, where appropriate, a report to the competent authorities. MISFIT may request proportionate age-assurance measures where necessary for safety or required by law.
3. Pseudonymity and minimum data
MISFIT is designed around pseudonymity. It does not require users to publish their real name, telephone number, address, identity documents, medical diagnoses, or an explanation of why they select a MISFIT category.
Pseudonymity does not mean that no data exists. To operate and protect users, the service necessarily processes certain information, including a verification email address, nickname, age, stated gender, language, selected categories, connection requests, messages, reports, acceptances and technical or security information. The Privacy Notice explains this processing.
Users must not place information in a nickname, profile or message that they do not wish to share. Selected categories are broad indicators and are not diagnoses, certifications or legal declarations.
4. Account responsibility and security
Every account is personal, individual and non-transferable. Users are responsible for the email address and devices used to access the service and for activity performed through their account, except for unlawful use reported without undue delay.
Users may not create multiple accounts to evade suspensions, blocks, conversation limits or security measures; sell, lend or transfer an account; use another person’s email; or automate access or activity without written authorisation.
5. Essential honesty and no impersonation
Although MISFIT does not require public disclosure of legal identity, essential honesty is mandatory. Users may not impersonate people, organisations or professionals; use another person’s images or information without authority; misrepresent age; or falsely claim qualifications, circumstances, intentions or conditions in order to manipulate another person.
6. Zero-tolerance conduct
MISFIT applies zero tolerance to:
- threats, intimidation, stalking, harassment or persistent contact after refusal;
- hatred, humiliation, discrimination or incitement against a person or group;
- violence, coercion, blackmail, extortion, exploitation or trafficking;
- unsolicited sexual content, sexual harassment, cyber-flashing or pressure for images, video, meetings or sexual activity;
- sharing or threatening to share intimate material, private conversations or personal data without consent;
- romance scams or requests for money, investments, loans, cryptocurrency, gifts, credentials or verification codes;
- grooming minors or any child sexual abuse material or conduct;
- promoting, selling or facilitating unlawful goods, services or conduct;
- malware, phishing, spam, advertising, commercial recruitment, automated propaganda or mass data collection;
- evading blocks, suspensions, technical limits or moderation systems;
- using MISFIT for private investigation, surveillance, profiling, public exposure or revenge.
A serious violation may lead to immediate removal, suspension or permanent termination without advance notice. Where appropriate or legally required, MISFIT may preserve relevant evidence and cooperate with competent authorities.
7. Communication and consent
Accepting a LOVE LINK authorises only the opening of a conversation within MISFIT. It is not consent to sexual communication, an in-person meeting, contact through other channels, additional data processing or any other activity.
Consent may be withdrawn at any time. Refusal, blocking, closure of a conversation or silence must be respected immediately. No user is entitled to a response, explanation, meeting or continued relationship.
8. Conversation limit
Users may send multiple LOVE LINKS, but may have no more than one active conversation resulting from an outgoing accepted request and one active conversation resulting from an incoming accepted request. Other requests may be frozen, queued, declined or cancelled according to the service’s operation.
Creating additional accounts or using external tools to evade this limit is forbidden.
9. Confidentiality and privacy of others
Users may not copy, publish, forward, sell or use outside the conversation another user’s nickname, profile, messages, photographs, audio, video or other content without explicit consent and a valid legal basis. Attempting to identify, geolocate or trace a user against their wishes is forbidden.
MISFIT recommends not disclosing an address, workplace, routine, identity documents, banking details or other sensitive information at an early stage.
10. Meetings outside MISFIT
MISFIT does not organise, verify, supervise or guarantee meetings between users. Any decision to communicate elsewhere or meet in person is made independently and at the participants’ own responsibility.
Users should arrange initial meetings in a public place, inform a trusted person, retain independent transport, avoid financial or logistical dependence and leave whenever uncomfortable. In an immediate emergency, contact local emergency services; MISFIT is not an emergency service.
11. Reporting, blocking and moderation
Users must be able to report suspicious content or conduct and block other users. Reports must be submitted in good faith. Knowingly false, abusive or coordinated reports constitute misuse.
MISFIT may use human review and technical tools to investigate reports, prevent abuse and enforce these rules. Measures may include a warning, functional limitation, freezing, precautionary suspension, content removal, permanent termination and prevention of re-registration.
MISFIT will act diligently, proportionately and non-arbitrarily, consistently with user safety, legal obligations and the need not to disclose confidential information or anti-fraud methods. Where required by applicable law, affected users will receive reasons and information about available remedies.
12. No user verification or endorsement
Unless expressly stated, MISFIT does not systematically verify identity, criminal history, marital status, health, finances, immigration status, qualifications or the truthfulness of user statements. The existence of an account is not approval, certification or endorsement.
Users must exercise independent judgement and caution. MISFIT does not guarantee compatibility, authenticity, response, meeting, relationship or result.
13. Health and personal categories
MISFIT does not provide medical, psychological, legal, immigration, financial or professional advice. Category labels are social orientation tools, not diagnoses. No user may demand clinical explanations, documentation or proof from another user.
Exploiting vulnerability, disability, emotional fragility, financial condition, immigration status or any personal circumstance to obtain advantage, control or consent is forbidden.
14. Intellectual property and technical licence
MISFIT’s marks, graphics, software, structure and proprietary material are protected by applicable law. Users retain rights in material they create, while granting MISFIT a limited, non-exclusive and revocable licence to the extent required to host, transmit, display to selected recipients, secure and moderate that material while the service is used.
Users warrant that they are authorised to use anything they upload or transmit.
15. Availability, modifications and experimental phase
MISFIT may be offered free of charge during its initial phase. Current free availability is not a promise of perpetual free access except where an express promotion applies to specific users. Features, limits, interface and availability may change for technical, economic, legal or safety reasons.
The service may experience interruption, error, lost connectivity or maintenance. MISFIT does not guarantee uninterrupted availability or permanent conversation storage. Material changes to these conditions will be communicated through appropriate means.
16. Withdrawal, deletion and termination
Users may stop using MISFIT and request deletion through the available functions or by contacting info@misfitdate.com. Deletion does not prevent limited retention required for legal obligations, safety, fraud prevention, dispute management or protection of others, as explained in the Privacy Notice.
MISFIT may suspend or terminate accounts for violation, risk to people or the service, legal obligation, fraud, prolonged inactivity or discontinuation of the service.
17. Limitation of liability
To the maximum extent permitted by law, MISFIT provides a technical contact tool and is not a party to users’ conversations, arrangements, meetings or relationships. MISFIT is not responsible for users’ statements, omissions, conduct or independent decisions, or for harm resulting from meetings or communications outside the service.
Nothing in these conditions excludes liability that cannot lawfully be excluded, including liability for intentional misconduct or gross negligence where applicable, or limits mandatory consumer rights.
18. Indemnity where legally permitted
To the extent permitted by law, users agree to hold the operator harmless against third-party claims directly caused by unlawful material they submitted, fraudulent use of the service or an intentional breach of these rules. No indemnity applies where prohibited by mandatory law.
19. Governing law and jurisdiction
These conditions are governed by Italian law. Any dispute shall be submitted to the courts of Rome, Italy, except where a consumer is entitled to a mandatory forum or where Italian, European Union or other applicable mandatory law provides otherwise.
Before beginning proceedings, the parties are encouraged, where reasonable and without affecting rights or deadlines, to seek a written resolution through info@misfitdate.com.
20. Final provisions
If one provision is invalid, the remaining provisions continue to apply. A temporary failure to enforce a rule is not a waiver. If language versions differ, the Italian version prevails to the extent legally permitted, without affecting mandatory user rights.
