1. Purpose of this notice

This notice explains what personal data MISFIT processes, why it is processed, the applicable legal grounds and the rights available to data subjects. MISFIT is designed around data minimisation, pseudonymity and confidentiality, but it cannot operate without processing some personal data.

2. Data we process

At registration we process the email address, nickname, declared age, declared gender, language, selected MISFIT groups, adult-status confirmation and electronic records of legal acceptances. During use, we may process LOVE LINK requests, conversations, messages, blocks, reports, moderation actions and technical or security data that is strictly necessary.

We do not ask for a real name, postal address, phone number, identity documents, diagnoses or explanations for selected categories. Users should not provide unnecessary information or anything they do not wish to disclose.

3. MISFIT groups and special-category data

Voluntarily selecting certain MISFIT groups may indirectly reveal information about health, social circumstances or other personal matters. The platform records only the broad group selected, not the reason. These selections are used solely to operate the profile and search or matching system, on the basis of the user’s explicit consent. Consent may be withdrawn without affecting prior lawful processing; withdrawal may limit or prevent functions that depend on those categories.

4. Purposes and legal grounds

Data is processed to create and manage accounts, verify email, display pseudonymous profiles, provide LOVE LINKS and conversations, enforce rules, prevent abuse, answer requests and comply with law. The legal grounds are performance of the requested service, explicit consent where necessary, legitimate interests in security and abuse prevention, and compliance with legal obligations.

5. Recipients and providers

Data may be processed by essential technical providers, including hosting, database, authentication, email, security and backup providers, within their assigned functions and applicable agreements. We do not sell personal data or use it for advertising profiles. Data and content may be disclosed to authorities where required by law or necessary to protect people and rights.

6. Visibility between users

Nickname, declared age, declared gender and selected groups may be visible to other users as necessary for the service. Email addresses, consent records and technical information are not intended for public display. Messages are visible to conversation participants and may be reviewed for reports, safety or legal obligations.

7. Retention

We retain data for as long as needed to provide the service, manage security and disputes, and comply with law. After account deletion, data is deleted or anonymised within reasonable technical periods, except where retention is needed for legal obligations, legal claims, fraud prevention or report handling. Acceptance records may be retained to document the legal relationship.

8. International transfers

Some providers may process data outside the European Economic Area. Where this occurs, we use safeguards recognised by applicable law, such as adequacy decisions, standard contractual clauses or other lawful instruments.

9. Security

We use proportionate technical and organisational measures, including access control, encrypted connections, system separation and backups. No Internet-connected system can guarantee absolute security. Users must protect their email account and device and promptly report suspicious access.

10. Your rights

Where provided by law, data subjects may request access, correction, deletion, restriction, portability, objection and withdrawal of consent. They may also complain to the Italian Data Protection Authority or the competent authority in their country. Requests should be sent to info@misfitdate.com from the address associated with the account; proportionate verification may be required to prevent fraudulent access or deletion.

11. Minors

MISFIT is strictly for adults and is not directed to minors. Accounts reasonably associated with minors may be suspended and deleted, and serious cases may be reported to authorities.

12. Changes and contact
